Training objectives

Course's aim is to obtain a basic knowledge of the fundamental principles and concepts of the Italian and European Competition Law, and the knowledge of the legislation concerning the italian Indipendent Regulatory Agencies, and, in particular, the regolatory and sanctioning powers of the Antitrust Authority.
This course also aims at obtaining the knowledge of the law of market regulation, and in particular of price regulation, as well as the public and private enforcement of the Competition Law.

Prerequisites

A basic knowledge of the constitutional principles (rectius: artt. 95 e 97 Constitution., the articles 41-47 of the Consititution and the law n. 241/1990 on the administrative proceedings.

Course programme

PART 1 of the Course: (Competition Law): 40 h.: The general principles and the european competition law; the most important judgments of the Court of First Instance of the E.U. concerning the protection of free competition;the Antitrust Authority and the legal review of its administrative decisions by national courts; the Law n° 287/1990: the principles and concepts concerning the protection of free competition; PART. 2 of the Course: 24 h (Regulation and Market Law): the Indipendent Regulatory Agencies in Italy; the relationship between competition Law and Regulation and Market Law; the european directive 2006/123 on services in the internal market and the Decree n°59/2010: the authorization regime of the market access and the price regulation. The Regulation of Road-Based Public Transportation.

Didactic methods

During the Course the lecturer will point out to students the mainstream positions of the legal scholars and courts. Some topics of the course programme will be deepened through the reading and discussions of some of the highest Courts' judgments
