CFP includes the conservation of marine biological resources and the management of fisheries targeting them. It includes also, in relation to market, and financial measures in support of its objectives, fresh water biological resources and aquaculture activities.
Knowledges to be acquired by students.
The aim of this course is to give the future legal experts the widest possible knowledge of EC Law on this subject, their relationship with national rules, the EC institutional framework, the different kinds of EC competences in CFP, the related matters and the EC policies, the external policy and the sustainable fisheries partnership agreements.
Skills to be acquired by students.
The course aims to give the future legal experts specific abilities to solve legal problems taking into account their multi-level dimension, the relationship between national and supranational legal systems, by acquiring the instruments that make them able to know the correct rules and interpretations applicable.
Prerequisites
Propedeutic course: European Law.
COURSE PROGRAMME:
This university course is structured in 40 hours (including both frontal lessons, exercises and seminars). In particular, 20 hours will be dedicated to the frontal lessons (2 hours for each recommended subject), 10 hours will concern guided exercises regarding each recommended subject, 8 hours will relate on various inter-disciplinary seminars.
In conclusion, the final 2 hours will be dedicated on training as to ameliorate the student’s database searching abilities with particular regard to the different regulations and case-law in the CFP.
1. CFP: evolution and consolidation of the common EU common fisheries policy before the the Treaty of Lisbon.
2. The subject’s codification in the III Part of the TFEU.
3. The specific EU competence in the different sectors of this subject. The “specificity” of aquaculture.
4. The EU’s decision making procedure.
5. The current set of rules and the EU Institution’s role.
6. EU’s external relations.
7. The European Union’s role in the international and regional fishery organizations.
8. EU’s policy to contrast illegal fishery.
9. The adaptation of domestic legislation to comply with EU fishery law.
10. The common market regulations in fishery and aquaculture products.

- DIDACTIC METHODS:
In the lessons the different and critical issues of the Course and will be examined in the framework of the most recent case-law. Ad every specific issue will be examined according to the examination of a real case that students will discuss about.
For the academic year 2022/2023 lessons will be held in presence. The teaching material will be available on Google Classroom. Learning assessment procedures
- LEARNING ASSESSMENT PROCEDURES:
Oral exam. For students attending the course oral exam with the discussion of a specific case.
For non-attending students there will be an oral exam with three different questions on the available teaching material recommended by the teacher. Reference texts
